RESIDENCE REQUIREMENTS FOR SCHOOL ADMISSION

 

 

The Plaquemines Parish School Board shall require a student to physically reside in the school attendance zone of the public school which he/she attends.  Residency requirements shall be in accordance with the following:

 

  1. A student shall physically reside with his/her parent(s) or legal guardian or custodian.  The residence must be within the Parish of Plaquemines.

  2. A student shall only have one residence.  The residence where the student physically resides shall determine the school which the student attends, regardless of whether said residence is with his/her parent or legal custodian or guardian.

  3. Residency Affidavits

 

  1. At any time that the administration of the Plaquemines Parish School Board deems fit, the School Board, through its administration, may request that a sworn affidavit, before a Notary Public, be made attesting to the actual, physical residence of the child in the school district; said affidavit having legal efficacy, and subject to the civil and criminal laws of the State of Louisiana.

  2. The affidavit shall be dated and signed by the affiant in the presence of a Notary Public.  The affiant shall be the parent or legal guardian with whom the child allegedly physically resides within the school district.  If the student's custody has been transferred by a Court Order to a person(s) not his/her parents, then the School Board may request an affidavit described in this section be signed by the student's parent(s).  A Provisional Custody Affidavit shall not be recognized by the Plaquemines Parish School Board for determining the legal residence of a student.

  3. Residency affidavits shall be resubmitted for approval at the beginning of each new academic school year.

  4. All affidavits shall be reviewed by the Child Welfare and Attendance Office for verification prior to the student’s enrollment.  The Child Welfare and Attendance Office shall be responsible for reporting to the Plaquemines Parish District Attorney’s Office or Sheriff’s Office, any individuals who are found to have provided false information to the School Board by use of an affidavit.

 

  1. In addition or alternatively to the procedures contained in number 3 above, at any time the administration of the School Board deems fit, it may take any other measures it deems necessary to confirm that a student resides in the school district where he/she attends school, including but not limited to, the following:

 

  1. Requiring the parent or legal custodian or guardian to appear at the school to verify the residence status;

  2. Inquiring of the local Postmaster to establish a physical address for the designated residence;

  3. Contacting neighbors to verify actual residence; and

  4. Visiting the student's designated residence to determine actual physical residence therein.

 

  1. The school officials, employees, bus operators, and administration of each public school in the Parish of Plaquemines have an affirmative duty to discover and determine the actual physical residence of each student attending the school.

    Should a school officer or employee have reason to believe that a student does not reside within the school attendance zone where he/she attends school, that school officer or employee shall report the student's identity and the reason(s) to the principal, who shall conduct an investigation pursuant to numbers 2 and 3 above.

 

  1. Any student who does not physically reside in the school attendance zone of the school where he/she attends school shall be removed from such school and enrolled in the proper school.  Written notification of the removal and transfer shall be provided the parent(s) or guardian/custodian, whichever has control over the student.

 

  1. The principal of the school shall notify the Superintendent of any action concerning a student who does not reside in the school attendance zone where he/she attends school, including the student's name, the names of his/her parents or custodian(s), and the basis of the custody relationship, i.e., Court Order, the student's actual residence, and the school where the student should attend school.

  2. The principal shall also notify the principal at the school where the student should attend school.

 

  1. The parent(s) or guardian/custodian(s) of any student who has been determined not to physically reside in the school attendance zone of the school where he/she attends school may appeal the decision of the principal to remove said student to the Superintendent or designee.  The appeal shall be in writing and shall be taken within five (5) calendar days from the date of receipt of the notification of removal and transfer by the principal.  The Superintendent or designee shall review the information gathered by the school officials, including verbal comments, and shall hear any evidence or verbal comments of the subject student and student's parents, or custodian/guardian, whichever one has custody of said student, after which a decision shall be rendered.  The Superintendent has the authority to make exceptions to the student residence requirements in cases of extreme circumstances considering the best interest of the child.  The decision of the Superintendent or designee shall be final.

    No appeal shall be taken in the event a parent, guardian, or custodian, or both fails to timely produce an affidavit, as described in number 3 above.

 

  1. A student who is expelled from another school system shall not attend any public school in Plaquemines Parish until the term of expulsion has been completed.

  2. Children of Plaquemines Parish School Board Employees

 

  1. In an effort to relieve hardship on its employees, the provisions of this policy shall not apply to any student whose parent(s) is/are employed by the School Board provided that such student physically resides with such parent(s).

  2. Upon express permission, as described hereinafter, of the Superintendent or his/her designee, such student shall be permitted to attend any school in the feeder system where that student's parent(s) is/are employed to work.

  3. In order for this exception to apply, the subject parent(s) shall request the permission of the Superintendent, or his/her designee, at least fifteen (15) days prior to the beginning of the semester.  The request shall be in writing, shall identify the name and grade of the student, campus assignment, and position of the parent/employee, and the nature of the hardship.  Within five (5) days of receipt of the request, the Superintendent or his/her designee shall grant or deny the request in writing.  Within such period, the Superintendent or his/her designee may conduct such additional investigation into the facts of the request as he/she deems appropriate.  The decision of the Superintendent or his/her designee shall be final.

  4. The provisions included in number 9 shall apply only to the natural or adopted children of employees of the School Board who physically reside with such parent(s).
